Zou3D provides access to services via subscriptions hosted on third-party platforms (such as Patreon). The services include:
Access to the services is conditioned upon payment and compliance with the policies and terms of the third-party platform where the subscription is purchased. Zou3D may, at its sole discretion, perform maintenance, updates, or modifications to the services, which may result in temporary interruptions. Such interruptions do not constitute a failure or breach by Zou3D and do not entitle the User to compensation or refunds.
Zou3D reserves the right to alter the characteristics of the services offered, providing prior notice to Users in the event of substantial changes.
Payments related to Zou3D subscriptions are processed by Third-Party Platforms, such as Patreon. The billing policies, timelines, payment methods, applicable taxes, and any potential refunds will be governed by the terms and conditions of these platforms.
The User may cancel their subscription at any time directly through the Third-Party Platform used to acquire the services. The cancellation:
The cancellation must be initiated by the User, as Zou3D does not have direct access to process cancellations on behalf of the User on Third-Party Platforms.
Upon cancellation, the User will lose access to the community, the right to sell 3D printing files, and other digital content at the end of the current billing period.
Zou3D grants the User a limited, non-exclusive, non-transferable, and revocable commercial license for the use of digital files provided by the company, strictly for the following purposes:
User Responsibility
By utilizing the commercial license, the User assumes full and exclusive responsibility for the use of the files and the commercialization of printed products. This includes:
Responsibility for Printed and Sold Products: The User is fully responsible for the products they print and sell, and assumes all liability for any risks, injuries, or damages caused to third parties, including children. The User must ensure that the products are safe for all intended consumers and are appropriately marketed.
Restrictions of the Commercial License
The commercial license granted by Zou3D does NOT permit the following:
Redistributing, sharing, sublicensing, selling, or making available the digital files provided by Zou3D, whether free of charge or for a fee;
Claiming authorship or making modifications to the digital files, which remain the exclusive property of Zou3D;
Creating derivative products or modifying the digital files for redistribution or commercialization purposes without explicit authorization from Zou3D.
Monitoring and Penalties
Zou3D reserves the right to monitor the use of its digital files and physical prints to ensure compliance with these Terms. Any misuse or violation of the provisions in this document will result in the immediate revocation of the commercial license and may include:
Suspension or termination of access to the services;
Legal action, including claims for damages resulting from copyright or contractual violations.
Disclaimer
By operating under this commercial license, the User understands and agrees that they act as an independent manufacturer or supplier, with no employment, partnership, or contractual relationship that transfers commercial or legal responsibilities to Zou3D. The User must be aware of their legal and operational obligations when printing and selling products.
Intellectual Property
The use of the commercial license does not transfer any intellectual property rights to the User. All rights to the digital files remain exclusively owned by Zou3D.

This clause survives the termination of these Terms and applies even after the suspension or termination of access to the services.
The User agrees to indemnify, defend, and hold Zou3D, its legal representatives, directors, employees, partners, and contractors harmless from any liability, loss, damage, cost, expense, or claim (including legal fees and court costs) resulting from:

These Terms of Use are governed and interpreted in accordance with Brazilian law, regardless of conflict of law principles.
The forum selected by Zou3D, within Brazilian territory, shall have exclusive jurisdiction to resolve any disputes arising from these Terms, to the exclusion of any other, no matter how privileged it may be.
The User explicitly agrees to make every effort to resolve disputes amicably by contacting Zou3D through its support channels before seeking judicial resolution.
Zou3D will not be held liable for any delays, failures, or interruptions in fulfilling its obligations under these Terms caused by force majeure events, which are external, unpredictable, and unavoidable events beyond the company’s reasonable control.

During a force majeure event, Zou3D’s obligations are suspended until the situation normalizes, without liability for losses, damages, or compensation to the User. Zou3D commits to making all reasonable efforts to restore service continuity as quickly as possible.
Zou3D may, at any time and without prior consent from the User, assign or transfer its rights and obligations under these Terms of Use, in whole or in part, to any legal entity or third party through merger, acquisition, corporate reorganization, or any other commercial transfer.
The User acknowledges and agrees that such a transfer does not affect their rights under these Terms. If the User disagrees with the transfer, they may cease using the services by requesting cancellation.
Conversely, the User may not assign or transfer their rights or obligations under these Terms without Zou3D’s prior and explicit consent. Any attempt to do so without consent is considered null and void.
If any provision of these Terms of Use is deemed invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions remain in full force and effect, unaffected in their validity or enforceability.
Zou3D and the User agree to negotiate in good faith to replace the invalid provision with one that preserves, to the greatest extent possible, the original intent of the parties and the contractual balance established.
